First, the agency considers the opinion of the treating doctor to be the most important document in the medical file. However, the critical opinion often does not exist. Why is this? Simply, doctors are involved in treatment. They are not concerned with legal disability issues.

Second, the agency will not allow doctors to make the legal determination in the case. Thus, if the doctor says a claimant is “disabled” the agency will reject this “naked” statement. The agency will say this is a legal determination to be made by the Social Security Judge.

Third, a mere statement that you are “disabled” will not be accepted. However, an opinion (from the treating doctor) stating what impact the claimant’s impairments have on important body functions can be extremely important and may be decisive in a case. For example, the doctor’s opinion on how long the claimant can walk, stand or sit is critical. Also, the doctor’s opinion regarding lifting, bending, etc. is critical.

Fourth, an experienced disability lawyer will have a set of evaluation forms for your doctor. They will be tailored for your individual impairment. For example, for a low back problem, there will be a lumbar spine form. This form will ask the doctor critical questions on how the low back problem impairs important body functions like walking, standing, sitting, lifting, bending, etc.

Fifth, unlike a “naked” statement of disability, this report will elicit what the doctor’s opinion is about the claimant’s ability to perform critical work activities. Cases for unpaid overtime arise under the Fair Labor Standards Act (“FLSA”), the federal law that generally provides for the payment of time-and-a-half overtime pay.

To win an unpaid overtime case, you must prove three (3) basic elements by a preponderance of the evidence:

(1) that you were employed by the defendant during the time involved;

(2) that your work was engaged in commerce or in the production of goods for commerce or the defendant’s business or businesses under unified operation or common control employed at least two persons and was engaged in commerce or the production of goods for commerce and had an annual gross sales of at least $500,000; and

(3) that the defendant failed to pay you overtime required by law.

Engaged In Commerce

The term “commerce” has a very broad meaning and includes any trade, commerce, transportation, transmission, or communication between any state and any place outside the state.

Examples of employees who are “engaged in commerce” under the Fair Labor Standards Act include anyone who uses a telephone, fax machine, the U.S. mail, or computer e-mail system to communicate with persons in another state. Also, it also includes employees who use electronic devices which authorize credit card purchases. As you can see the definition is very broad and determined on a case by case basis.

Calculating Overtime Rate

The Fair Labor Standards Act generally requires an employer to pay its employees at a rate of at least one and one-half their regular rate for time worked in one work week over forty hours. This is commonly known as time-and-a-half pay for overtime work.

An employee’s “regular rate” during a particular week is the basis for calculating any overtime pay due for that week. The regular rate for a week is determined by dividing the first 40 hours worked into the total wages paid for those 40 hours. The overtime rate, then, would be one and one-half of that rate and would be owed for each hour in excess of 40 hours worked during the work week.

Exemptions Under FLSA

Most employers justify not paying overtime by claiming an “exemption.” Probably the most common exemptions are the executive and administrative exemptions, but there are many more.

To receive the benefit of an executive exemption, the defendant must prove that your primary duty was managing the business or department of the business. For example, an executive director would likely be exempt under the FLSA, if they directed the work of at least two or more employees and had the authority to hire or fire other employees, or their suggestions and recommendations as to the hiring, firing, advancement, promotion, or any other change of status of other employees were given a particular weight.

To receive the benefit of an administrative exemption, the defendant must prove that your primary duty was the performance of work directly related to the management or general business operation of your employer and you exercised discretion and independent judgment with respect to matters of significance. An office manager may qualify for the administrative exemption.

When determining whether or not you’re an exempt employee it’s important to remember that what matters is the work you actually performed, not your written job description. In other words, if your job description states that you’re a manager, yet your primary duty is that of a front desk clerk, you’re likely non-exempt and owed overtime. As you may imagine, these type of cases are very fact dependent and vary on a case by case basis.

Damages

The measure of damages or money under the FLSA is the difference between what you should have been paid under the Act and the amount that you were actually paid. This is called back pay. Damages are not allowed as a punishment and cannot be imposed or increased to penalize your employer.

6. Share tracts and flyers

This is another method of winning souls. Some people may not know what to say but with tracts or flyers, they can still share the word of God with people. Also, you can use the tracts and flyers to reach out to people when you’re not permitted to preach, or you or they are in a hurry. And, since the Holy Spirit is the one converting, He can use the message in the materials to convert the person(s).

Paul used his letters to reach out to people when he was not opportune to reach out to them in person. And these letters are still speaking to us today.

7. Invite them to church

The church is the place the Lord commands that we should not forsake. This is because it’s a place where He fellowships with us, teaches us, and releases His blessings on us.

Also, it’s the right place to nurture new converts into maturity in Christ. They need the word to grow. Again inviting unsaved people to your ‘bible believing church’ will give them the opportunity to hear the word of God and be saved. Furthermore, inviting the new converts to church will help you to follow them up till they mature and establish in Christ.

8. Follow them up

It’s one thing to lead someone to Christ and it’s another to have them abide in Him. Jesus said we should go and bring forth fruit that will abide.

Truly, many people have given their lives to Christ at one time but aren’t anymore in Christ. And the main reason is that they were not nurtured into maturity in Christ. These are the people described in the parable of the sower as those seeds that didn’t fall on the good soil. So, when a lack of understanding, persecution, and care of the world attack them, they fall out of faith.

Therefore, it’s important that you follow up your converts, and not allow the enemy to plunge them back into sin and condemnation. Remember, no mother gives birth and abandons the baby to feed and fend for himself or herself. Rather, she will nurture them till maturity.

Continued prayer for your converts is crucial for their growth and maturity in Christ. It is also part of the follow-up process. This is because in prayers you cover them and protect them from the attacks of the enemy till they can stand and fight for themselves. In Colossians 4:12, we see an example of Epaphras praying fervently for the spiritual establishment of the Colosse new converts.
